CREATING A SEXUAL HARASSMENT FREE WORKPLACE
A safe workplace is a woman’s legal right. Indeed, the Constitutional doctrines of equality and personal liberty are contained in Articles 14, 15 and 21 of the Indian Constitution.
Today, all Indian workplaces are required by law to provide a safe and secure working environment free of sexual harassment for all women.
Having raised the bar of responsibility and accountability in the Vishaka Guidelines, the Supreme Court placed an obligation on workplaces, institutions and those in positions of responsibility, to uphold working women’s fundamental right to equality and dignity at the workplace.
Three key obligations were imposed on institutions to meet that standard

ICC – Internal Complaint Committee formation.
Provide Experienced External Member for your ICC.
Conduct the Orientation Sessions for all ICC members.
Conduct enquiry in case of Sexual Harassment complaint.
Provide Posters, Training Materials and all required templates for PoSH.
Assistance in Annual Report Filing for PoSH Compliance.
Is your organization PoSH compliant?
If your workplace has 10 and more than 10 employees, under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, you are mandated to:
Number of complaints received in a year
Number of complaints disposed of in a year
Number of cases pending for more than 90 days
Number of awareness programs or workshops conducted to create sensitization on this law
Nature of action taken by the employer in the complaints.
